An Overview of Youth Rights in Facilities

This resource provides an overview of the constitutional and federal laws that are implicated when young people are placed in juvenile or adult facilities and includes concrete examples of common violations. This resource offers an introduction for youth defenders on how to spot federal and constitutional violations based on conditions of confinement and suggests helpful practice tips for youth defenders representing young people in detention, probation violation, and disposition proceedings. Youth defenders may use this resource to inform their advocacy whenever a young person faces incarceration to ensure that the federal and constitutional rights of youth are fully and adequately protected.
