“Gary Montgomery, a mentally disabled man, was arrested in 2012 and charged with the murder of Deoni Jones. After five and a half years of incarceration pending trial, a jury found Montgomery not guilty. Montgomery’s amended complaint alleges that defendant District of Columbia violated his rights under Title II of the Americans with Disabilities Act (ADA), 42 U.S.C. §§ 12131–12134, and Section 504 of the Rehabilitation Act, 29 U.S.C. § 794, by failing to accommodate his disability during the investigation. The District has moved for summary judgment on both claims. Def. District of Columbia’s Mot. for Summ. J. [ECF No. 53] (“Mot.”) at 1. For the reasons explained below, the Court will deny the District’s motion.”
